Terms and Conditions for Castaways Weddings & Hospitality

These Terms and Conditions outline the agreement between Castaways Weddings & Hospitality (referred to as “the Company”, “we”, or “us”) and the Client (“you” or “Client”) regarding the provision of wedding planning, hospitality, and related services. By engaging with Castaways Weddings & Hospitality, you agree to comply with these Terms and Conditions.

1. Services

1.1. The Company provides wedding planning, event management, and hospitality services, as outlined in the proposal or contract.

1.2. The specific services will be detailed in a signed agreement between the Company and the Client.

1.3. Any additional services requested after the agreement is signed will incur additional charges.

2. Booking and Payment

2.1. Booking Confirmation:
  • A booking is confirmed upon receipt of a signed agreement and payment of the booking advance.
2.2. Payment Terms:
  • The Client must adhere to the payment schedule outlined in the agreement.
  • Payments are non-refundable unless specified otherwise.
  • Late payments may result in delays or cancellation of services.
2.3. Advance Payment:
  • An advance payment of 50% of the total cost is required at the time of booking.
  • The remaining amount must be paid as per the agreed milestones or at least 7 days before the event date.

3. Cancellation Policy

3.1. Cancellations must be made in writing by email or letter.
 
3.2. Refunds for cancellations will be processed as follows:
 
  • More than 60 days before the event date: 50% refund of the advance payment.
  • 30-60 days before the event date: 25% refund of the advance payment.
  • Less than 30 days before the event date: No refund.
3.3. Postponements are treated as cancellations unless otherwise agreed upon.
 
3.4. All advance payments are non refundable under any circumstance.
 
3.5. The Organisation deserves the right to charge a hundred percent of the total bill on cancellation received within 15 days of the event.
 
3.6. In case of cancellation or change in date of a function, all advances received are non-refundable.

4. Changes to Services

4.1. Changes to the agreed services must be requested in writing.

4.2. The Company will accommodate changes subject to feasibility and availability.

4.3. Any additional costs arising from changes will be charged to the Client.

5. Client Responsibilities

5.1. The Client must provide accurate and complete information regarding event details, timelines, and preferences.

5.2. The Client must ensure that all necessary permits, licenses, and permissions for the venue and event are obtained.

5.3. The Client is responsible for any damages caused by their guests, vendors, or third-party service providers engaged by them.

6. Vendor and Third-Party Services

6.1. The Company may recommend third-party vendors for specific services (e.g., catering, decoration, photography).

6.2. The Company is not responsible for the performance, quality, or reliability of third-party vendors not directly managed by the Company.

6.3. If the Client wishes to engage external vendors, prior approval must be obtained from the Company.

7. Force Majeure

7.1. The Company will not be held liable for failure to perform services due to events beyond its control, including but not limited to natural disasters, government restrictions, pandemics, strikes, or unforeseen emergencies.

7.2. In such cases, efforts will be made to reschedule the event or provide alternative solutions, subject to availability and feasibility.

8. Liability

8.1. The Company will exercise reasonable care in delivering its services but is not liable for:
  • Losses or damages caused by third-party vendors or external factors.
  • Any delays, interruptions, or cancellations caused by unforeseen circumstances.
8.2. The Company’s liability is limited to the amount paid by the Client for its services.

9. Confidentiality and Privacy

9.1. The Company will maintain confidentiality regarding all personal and sensitive information provided by the Client.

9.2. The Client agrees that the Company may use event photographs or videos for promotional purposes unless explicitly prohibited in writing.

10. Governing Law

10.1. These Terms and Conditions are governed by the laws of India.

10.2. Any disputes arising from this agreement will be resolved in the courts of Kolkata, West Bengal.

11. Agreement and Acknowledgment

All confirmations must be received in writing and acknowledged by the organization. A confirmation from the guest means that the guest accepts all the terms and conditions. If you agree to the above arrangements and the terms and conditions, please send us your acceptance by return mail.

By engaging Castaways Weddings & Hospitality, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
